These terms govern your use of festivetees.us and any order you place with Festive Tees, operated from Arlington, Texas, United States. By using the site or buying from us, you agree to them. Questions: aogunde3@gmail.com.
The shop
We sell limited seasonal apparel. Products are printed on demand by Printful after you order. Listing photos are digital mockups. Small differences in color, print size, placement, and garment finish are normal and are not defects. We do not guarantee that a design will look identical to the on-screen mockup on every blank or under every lighting.
Eligibility
You must be able to form a contract in your place of residence. The shop is not directed at children under 13. If you order, you confirm the information you give us is accurate.
Orders, pricing, and payment
Prices are in US dollars and may change until you pay. Taxes are calculated at checkout where Shopify collects them. We may refuse, cancel, or limit an order (for example if an item cannot be printed, inventory or print files fail, or we suspect fraud or payment abuse). You are responsible for a complete, accurate shipping address and for keeping your email reachable for order and delivery notices.
Payment is processed by Shopify Payments and related processors. We do not store full card numbers. By paying, you authorize the charge for the items, shipping, and tax shown at checkout.
Fulfillment and shipping
Printful prints, packs, and ships as an independent fulfillment partner. Production plus transit time varies by destination and garment. We do not guarantee a calendar delivery date, including for holidays or events. Title and risk of loss pass when the carrier delivers, or when Printful hands the package to the carrier, as applicable. Duties, VAT, or import fees on international orders are yours if they apply. Wrong address after shipment is treated under the Refund Policy.
Refunds, store credit, and cancellations
Refunds, replacements, cancellations, store credit, lost packages, and chargebacks follow our Refund Policy, which is part of these terms. In short:
- Confirmed print defects, wrong items, damage, and confirmed loss: we replace first; refunds default to Shopify store credit, with a refund to the original payment method when you ask or when the law or card-network rules require it
- Change of mind, size/color preference, and ordinary mockup variation: not refundable. Any goodwill exception is store credit only
- Cancellations only if production has not started, unless we cancel because we cannot fulfill
Store credit lives on your Festive Tees customer account, does not expire, is not transferable, and is not cash except where required by law. Using store credit at checkout may require signing in or Shop Pay.
Chargebacks and payment disputes
Email us before asking your bank to reverse a charge. A chargeback is not a substitute for this policy. If we already replaced the item, issued store credit, or refunded the order, we will contest a second recovery of the same amount and may refuse future orders. We keep order records, tracking, photos you send, and copies of these policies as they appeared when you checked out.
Intellectual property
Festive Tees designs, names, mockups, and site content are ours (or used with permission). You may not copy, resell, scrape, or reproduce the artwork except as printed on an item you purchased for personal use. You may not use our brand or designs to imply we endorse you.
Acceptable use
Do not misuse the site: scraping at a volume that harms the shop, attacking, interfering with checkout, posting unlawful content, or placing orders with stolen payment methods. We may suspend access, cancel orders, and keep funds required to cover fraud losses as allowed by law.
Electronic communications
You agree we may send order, shipping, and policy notices to the email on your order. Legal notices to us go to aogunde3@gmail.com.
Disclaimer and liability
The site and products are provided as available. To the fullest extent allowed by law, Festive Tees is not liable for indirect, incidental, special, or consequential damages, including lost events or late holiday delivery. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some places do not allow certain limits; in those places our liability is limited to the maximum the law allows. Nothing here limits liability that cannot be limited, such as for fraud or personal injury where the law forbids it.
Privacy
How we handle personal information is described in our Privacy Policy. Checkout, payments, and fulfillment involve Shopify, Printful, and carriers.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree to try to resolve a dispute by emailing us first. If we cannot resolve it, courts located in Tarrant County, Texas have exclusive jurisdiction, except that either of us may seek injunctive relief elsewhere to protect intellectual property. If a court finds part of these terms unenforceable, the rest still applies. We may update these terms; the date at the top will change when we do. Continued use after an update means you accept the new terms. The current Refund Policy and Privacy Policy are incorporated into these terms.
